TERMS OF USE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Caramba mobile application ("the Application"), you agree to be bound by these Terms of Use ("Terms"). If you do not accept these Terms, please do not use the Application.

These Terms constitute a legally binding agreement between you and Caramba ("we", "our").

2. DESCRIPTION OF SERVICE

Caramba is a mobile application that uses artificial intelligence to:

• Automatically detect cars in your photos
• Apply creative transformations and filters to your car images
• Manage your creations on your device

Free version

The free version allows you to discover the application with limited features.

PRO version

The PRO subscription unlocks full access to the application, including:

• Access to all available filters and transformations
• Ability to save your creations to your device
• Ability to share your creations with friends and on social media
• Priority access to new features

3. LICENSE OF USE

3.1. Limited license

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal and non-commercial purposes, subject to compliance with these Terms.

3.2. Restrictions

You agree not to:

• Copy, modify, distribute, sell, or rent any part of the Application
• Reverse engineer, decompile, or disassemble the Application
• Remove, alter, or obscure any copyright or other proprietary notices
• Use the Application for illegal, fraudulent, or harmful purposes
• Attempt unauthorized access to our systems or networks
• Use the Application to create offensive, defamatory, or illegal content

4. ACCOUNT AND SUBSCRIPTION

4.1. User account

The use of certain features of the Application may require the creation of a user identifier managed by our payment service RevenueCat.

4.2. Subscriptions

The Application offers paid subscriptions (PRO) that unlock additional features:

• Subscriptions are available in monthly or annual plans
• Payment will be charged to your App Store account upon confirmation of purchase
• Subscription automatically renews unless you disable it at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscriptions and disable automatic renewal in your App Store account settings

4.3. Free trial

If a free trial is offered:

• You must cancel before the end of the trial period to avoid being charged
• Cancellation takes effect at the end of the current trial period

4.4. Refund policy

Purchases made through the App Store are subject to Apple's refund policy. We do not have direct control over refunds. To request a refund, please contact Apple support or check your purchase history in the App Store.

5. USER CONTENT

5.1. Your photos

You retain all rights to the photos you upload to the Application. By using the Application, you grant us a limited license to process your photos solely for the purpose of providing our services.

5.2. Content responsibility

You are solely responsible for the photos you upload and transform. You warrant that:

• You own the necessary rights to the photos you use
• Your photos do not violate any intellectual property rights
• Your photos do not contain illegal, offensive, or defamatory content

5.3. Transformed images

Transformed images generated by the Application belong to you. You are free to save, share, and use them as you see fit, subject to compliance with applicable laws.

6. INTELLECTUAL PROPERTY

The Application, including but not limited to its code, design, graphics, interface, and content, is protected by intellectual property laws. All rights, title, and interest in the Application belong to Caramba and its licensors.

7. PRIVACY

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Application, you consent to the practices described in our Privacy Policy.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

• We do not guarantee that the Application will be error-free, secure, or available at all times
• We are not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Application
• We are not liable for any loss of data, photos, or content
• We are not liable for the results of image transformations generated by artificial intelligence

9. AVAILABILITY AND MODIFICATIONS

We reserve the right to:

• Modify, suspend, or discontinue the Application or certain features at any time
• Modify these Terms at any time. Changes will take effect upon publication in the Application
• Terminate your access to the Application in case of violation of these Terms

Your continued use of the Application after modifications constitutes your acceptance of the new Terms.

10. TERMINATION

You may stop using the Application at any time by uninstalling it from your device. We may terminate or suspend your access to the Application immediately, without notice or liability, if you violate these Terms.

11. GOVERNING LAW

These Terms are governed by the laws of France, without regard to conflicts of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the French courts.

12. USE OF THIRD-PARTY SERVICES

The Application uses third-party services to provide its features:

• Google Gemini: for car detection and image transformation via artificial intelligence
• RevenueCat: for subscription and in-app purchase management
• Supabase: for backend functions hosting

The use of these third-party services is subject to their own terms of use and privacy policies.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Caramba, its officers, employees, and partners from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising from:

• Your use of the Application
• Your violation of these Terms
• Your violation of the rights of any third party
• Content you upload or create through the Application

14. GENERAL PROVISIONS

14.1. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Caramba regarding the use of the Application.

14.2. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

14.3. Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
